The short version. Ten sticker spots, fixed price, each sold once. You pay, send a logo or a sticker, I approve it and put it on the lid. Each customer gets one dedicated Instagram Reel. The logo stays on the phone while the current generation is active. A generation ends when all ten spots have been sold, after which a new phone and a new set of ten spots may begin. Gambling, betting, crypto tokens and adult content are not accepted. You have 7 days to provide your artwork or sticker. I do not promise views, reach or any particular advertising result.

What you are buying

Spot For Sale offers limited physical logo placements on the back of an iPhone used by the operator of Spot For Sale. There are ten spots in each phone generation. Each spot is sold once, at the price shown on the page.

Buying a spot gets you:

• Your logo printed as a die-cut vinyl sticker and applied to the spot you chose, unless you provide your own suitable physical sticker.
• A dated photograph showing your logo after application.
• Your logo and, where applicable, a link to your website or other designated online destination displayed on the Spot For Sale website.
• One dedicated Instagram Reel for your purchase.
• The iPhone and your logo appearing naturally in videos or photographs created by Spot For Sale while the logo remains on the phone. There is no separate charge for this and no minimum number of additional videos.

The dedicated Instagram Reel is part of the service. The creative execution, filming, editing, caption, music and presentation are determined by the operator.

This is a personal project. It is not affiliated with, endorsed by, or sponsored by Apple Inc. iPhone and Apple are trademarks of Apple Inc.

Brands I do not accept

Gambling, betting, crypto tokens and adult sexual content are not accepted. These categories are not available for purchase through Spot For Sale.

The operator may also refuse other material where reasonably necessary, including material that is unlawful, misleading, infringing, fraudulent, or creates a serious legal, platform, safety or reputational issue.

If the operator refuses a purchase for a reason unrelated to the customer's failure to provide the required artwork or sticker, the payment will be refunded, subject to any mandatory legal requirements.

Approval

Every sponsorship is reviewed by hand before the customer's material is used. The operator retains final control over what appears on the phone and on Spot For Sale channels.

The operator may refuse submitted material that does not meet these Terms or that cannot reasonably be used as part of the Spot For Sale project.

Your artwork, or your own sticker

After payment, the operator may contact you regarding the artwork required for your spot. You have two ways to fill your spot:

• Send a logo. The preferred formats are SVG or high-quality PNG with a transparent background. Where appropriate, the operator may prepare a visual mock-up on a photograph of the actual phone before producing the sticker.
• Send a physical sticker you already have. If it is suitable for the selected spot, the operator may apply it as received.

By sending a logo, artwork, name, sticker or other material, you confirm that you own it or have the necessary rights, licences or permissions to use it.

You grant the operator the permission necessary to print, reproduce, apply, photograph, record and display the submitted material as part of the purchased placement and its promotion.

You also agree that the operator may film and photograph the parcel being opened, the sticker being applied, the logo on the lid, and the completed placement. Such material may be published on Instagram, TikTok, YouTube and other social-media channels used by Spot For Sale.

7 days to provide your artwork

You have 7 calendar days from the date of purchase to provide the required artwork or physical sticker.

The operator may contact you during this period to request the required material.

If the required artwork or suitable physical sticker is not provided within 7 calendar days, the operator may release the spot and make it available for purchase by another customer.

For customers who are not protected by mandatory consumer-law rights, failure to provide the required artwork or sticker within this period does not create a right to a refund.

Nothing in this section limits any mandatory rights that cannot legally be excluded.

How long the logo stays

There is no 30-day minimum period. The logo remains on the current phone while the current phone generation is active, unless removal is required for practical, legal, technical or safety reasons.

A phone generation ends when all ten spots have been sold.

Once all ten spots have been sold, the current generation ends. The operator may then obtain a new phone and open a new generation containing ten new spots.

Previously published Instagram Reels may remain publicly available after the current generation ends. The operator does not have to delete previously published Reels when a generation ends.

Loss or theft of the phone

The phone is used by the operator in ordinary daily life.

If the phone is lost or stolen, the operator may be unable to continue the physical placement on that device or create further content involving that device.

Previously published photographs, Reels and other content remain online unless removed by the operator or the relevant platform.

The operator is not responsible for losses caused by theft, loss or other circumstances outside the operator's reasonable control.

Mandatory consumer rights remain unaffected.

What I do not promise

I make no promise about impressions, views, clicks, reach, likes, comments, followers, sales, leads, conversions or any other marketing results.

Social-media distribution and audience response are outside the operator's control.

You are buying the physical placement and the specific elements of the service described in these Terms, not a guaranteed advertising result.

A sticker is a paid promotional placement, not an endorsement. Spot For Sale does not represent that it endorses, sponsors or recommends the customer, its brand, products or services.

If a brand later turns out to be fraudulent, unlawful, infringing, materially misleading, or materially different from the material originally approved, the operator may remove the sticker and delist the corresponding placement. Mandatory consumer rights remain unaffected.

Refunds

Refunds are handled in accordance with these Terms and applicable mandatory law.

• Full refund: the operator declines the purchase for a reason unrelated to the customer's failure to provide the required artwork or sticker, where a refund is applicable.
• No refund: the customer does not provide the required artwork or sticker within the applicable 7-day period, except where mandatory consumer law provides otherwise.
• No refund: the customer knowingly purchases a placement for gambling, betting, crypto tokens or adult sexual content, subject to mandatory consumer rights.
• No refund: the submitted brand or material is later determined to be fraudulent, unlawful, infringing or materially different from what was approved, subject to mandatory consumer rights.

Payment and taxes

Payments are processed by Stripe. Payment card details are entered through Stripe's payment interface and are not directly handled or stored by the Spot For Sale website.

Prices displayed on Spot For Sale are exclusive of VAT unless explicitly stated otherwise. VAT and any other taxes applicable to a particular transaction will be handled in accordance with applicable law and the information presented at checkout.

Business customers may provide business details and a tax identification number where applicable.

The tax treatment of a purchase may depend on the customer's status, country and other circumstances required by applicable tax law.

Business and consumer customers

Spot For Sale may be purchased by businesses, creators, organisations, projects, pages and private individuals.

A customer purchasing for purposes relating to their business or professional activity may be treated as a business customer where applicable law so provides.

A customer purchasing for private purposes may have statutory consumer rights.

Nothing in these Terms excludes or limits mandatory consumer protection rights.

Consumer right of withdrawal

If the customer is a consumer and the agreement is a distance contract to which the statutory right of withdrawal applies, the consumer generally has a statutory 14-day withdrawal period, subject to the exceptions provided by applicable law.

The customer may expressly request that Spot For Sale begins performing the service before the expiry of that 14-day period.

Where required by law, the customer will also be informed that, once the service has been fully performed with the customer's express consent and after the required information has been provided, the statutory right of withdrawal may be lost.

If the consumer withdraws from the contract after performance has begun but before the service has been fully performed, the consumer may be required to pay for the part of the service already performed, where and to the extent required by applicable law.

Nothing in these Terms limits any mandatory consumer protection rights.

Recording and publication

The customer understands and agrees that the process of receiving, preparing, applying and presenting the logo may be photographed and recorded.

The operator may publish recordings or photographs showing:

• the customer's logo or name;
• the physical sticker;
• the application process;
• the customer's supplied package or sticker;
• the iPhone and its other existing placements.

The operator may publish this material on Instagram, TikTok, YouTube and other social-media channels used by Spot For Sale.

Each new customer receives one dedicated Instagram Reel relating to their purchase.

The operator controls the creative execution, filming, editing, caption, music, publication time and presentation of the Reel.

Intellectual property

The customer retains ownership of intellectual-property rights in material supplied by the customer.

The customer grants Spot For Sale the permission necessary to display, photograph, record, reproduce and publish the supplied logo, artwork, name or other material as part of the purchased placement and its promotion.

This permission covers the Spot For Sale website, Instagram, TikTok, YouTube and other social-media channels used to document or promote the project.

No endorsement

A logo, brand, project or name appearing on the Spot For Sale phone, website or social-media content does not mean that Spot For Sale endorses, sponsors or recommends that customer, brand, product or service.

The placement is a paid promotional placement.

Multiple spots

A customer may purchase more than one spot where multiple spots remain available.

Each purchased spot remains a separately purchased spot. Where several spots are purchased by the same customer, the operator may, where technically and visually suitable, treat the placements as one larger visual arrangement.

Website information

Spot availability shown on the website is subject to successful payment and the current status of each spot.

A spot is considered sold only after successful payment has been confirmed.

The operator may correct obvious pricing, availability or technical errors.

Apple disclaimer

Spot For Sale is not affiliated with, endorsed by, sponsored by or otherwise connected with Apple Inc.

iPhone and Apple are trademarks of Apple Inc.

Changes to the service

The operator may make reasonable changes to the website, presentation, social-media format, filming style or operational aspects of Spot For Sale.

Such changes will not remove the core purchased placement or the dedicated Instagram Reel included with the purchase, except where circumstances outside the operator's reasonable control make performance impossible.

Force majeure

The operator is not responsible for failure or delay caused by circumstances outside the operator's reasonable control, including theft or loss of the phone, serious technical failures, social-media platform outages, account restrictions, natural disasters, government actions or other comparable events.

Mandatory consumer rights remain unaffected.

These Terms are governed by the laws of Poland, subject to any mandatory consumer-protection provisions that apply to consumers in their country of residence.

Changes to these Terms

These Terms may be updated from time to time.

Changes will not retroactively remove mandatory rights or materially alter the terms of a purchase that has already been completed, except where required or permitted by applicable law.
